Modifly (Pty) Ltd is the responsible party (as defined in POPIA) for personal information processed in connection with this website and related business enquiries.
Our divisions operate under the Modifly brand and include Consult, Coded, Cloud, and Connect. Where a division processes personal information on our behalf or as part of a shared customer engagement, this Policy continues to apply unless a separate agreement says otherwise.

6.1 Operators

Some of our service providers may process or store information outside South Africa (for example cloud hosting, analytics, or email platforms).
Where personal information is transferred outside the Republic, we take reasonable steps to ensure that the recipient is subject to a law, binding corporate rules, or binding agreement that provides an adequate level of protection consistent with POPIA section 72, or that another lawful transfer ground applies.
8. Retention
We retain personal information only for as long as reasonably necessary to fulfil the purposes for which it was collected, including to satisfy legal, accounting, reporting, or dispute-resolution requirements.
Enquiry records are typically retained for a reasonable business period unless a longer retention period is required by law or an active engagement. Website analytics data is retained according to the relevant provider configuration and our operational needs.
When personal information is no longer required, we will delete, destroy, or de-identify it in a manner that prevents reconstruction, subject to backup and archival constraints.
9. Security
We implement reasonable and appropriate technical and organisational measures to protect personal information against loss, damage, unauthorised access, destruction, or unlawful processing, having regard to the nature of the information and the risks presented by processing.

- Withdraw consent where processing is based on consent (withdrawal does not affect prior lawful processing)

11. Children
Our website and services are directed at businesses and adult professionals. We do not knowingly collect personal information from children under 18. If you believe we have collected such information, please contact us so that we can delete it.
